Affiliate Programme Terms and Conditions
1 Definition
In these terms and conditions, “we” or “us” means EVIOS Plc, trading as Andersen EV; “you” means the person, firm or company named on the application form; and “our” or “your” shall be construed accordingly. This is an agreement between us and you to open an Andersen EV or EVIOS affiliate account as part of the affiliate program “the program”. You will be deemed to have consented to these terms by proceeding with your application form.
2 Modification
We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not limited to changes in the scope of available referral fees, fee schedules, payment procedures, and Program rules. If any of the modifications are unacceptable to you, your only recourse is to terminate this Agreement. If you continue participation in the program, it will be considered as your acceptance of the changes.
3 Enrolment
To enroll in the program, you must submit an application and be approved.
We will ask you for documents to support your application. We may request additional documents at our discretion at any time.
4 Application approval
Applicants will be notified of their acceptance status as soon as their information is reviewed.
Applications will only be approved if you provided all the documents requested, any incomplete application will be rejected.

5 Discount policy
We understand that some of your customers will want Andersen EV or EVIOS products. As our partner, we value your customer referrals, and we will help you in converting more of your customers into Andersen EV or EVIOS customers.
5.1 Discount
If you are approved as an Andersen or EVIOS installer, you may be entitled to a discount on the purchase of Andersen EV or EVIOS products. This discount will be linked to your account.
5.2 Misuse
We will check every order placed where an affiliate account has been used. We reserve the right to cancel the order in case of misuse of the code. Misuse includes but not limited to:
1. Use of the affiliate account by an individual other than you.
2. Use of the affiliate account by a company other than yours.
5.3 Order Fulfilment
We will be solely responsible for processing every order placed by a customer.
You are not authorized to collect payments or sell any Andersen EV or EVIOS products either directly or from other websites as a “reseller” and no “resale” rights are granted in any way.
You are not authorized to sell any of these products on eBay or other auction sites.
You are not authorized to give away any of these products.
Customers who purchase products and services through you will be deemed to be customers of Andersen EV or EVIOS. Accordingly, all rules, policies, and operating procedures concerning customer orders and service will apply to those customers.
We may change our policies and operating procedures at any time. Discount available to you, prices and availability of our products and services may vary from time to time. Our policies will always determine the price paid by the customer.
5.4 Prohibited Usage
The following cases prohibited and are grounds for immediate termination of the account, where applicable:
- You may not promote your discount amount or discounted price on any digital or non-digital medium, including but not limited to websites, press, email.
- You may not use on an unauthorized web URL, other digital or non-digital mediums: Andersen EV or EVIOS logo, logo marks, or other Andersen EV or EVIOS website/branding imagery in a header graphic or in any as to indicate they are officially affiliated or partnered with Andersen.
6 Andersen EV and EVIOS Brand and Assets
We place a lot of emphasis on our brand and our brand perception. That’s why it’s important that every participant in our affiliate program follow our brand guidelines.
6.1 Brand guidelines
Any digital and non-digital assets, including website, image, video, print, written instruction that include the Andersen EV or EVIOS branding (including logo, images, videos, instruction, manuals, diagrams, etc…) must be approved by us before being made available publicly.
6.2 Permitted Usage
You may use any assets that we make available to you with our prior written permission, including:
- Images, banners, and logos
- Manuals, instructions, contract
- Videos

7 Limitation of Liability
We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, expenditures, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total discount that you get under this Agreement.

Andersen EV and/or EVIOS operates a ‘return to base’ warranty and by purchasing our hardware through your affiliate account you are agreeing to these warranty terms.
9 Data protection
We shall only supply to you, and you shall only process, in each case under or in relation to this Agreement, the Personal Data of Data Subjects falling within the categories specified in Part A of Schedule 1 (Data processing information).
We shall only supply to you, and you shall only process Personal Data of the types specified in Part A of Schedule 1 (Data processing information).
You shall only process Andersen EV or EVIOS’ Personal Data for the purposes specified in Part A of Schedule 1 (Data processing information).
You shall only process Andersen EV or EVIOS’ Personal Data as specified in Part A of Schedule 1 (Data processing information).
You shall only process Andersen EV or EVIOS’ Personal Data on the written instructions of Andersen EV or EVIOS set out in this Agreement or any other document agreed by the parties in writing.
Notwithstanding any other provision of this Agreement, you may process Personal Data if and to the extent that you are required to do so by applicable law. In such a case, you shall inform us of the legal requirement before processing, unless that law prohibits such information on grounds of public interest.
You shall ensure that persons authorised to process Andersen EV or EVIOS’ Personal Data have committed themselves to confidentiality, or are under an appropriate statutory obligation of confidentiality.
You shall implement appropriate technical and organisational measures to ensure an appropriate level of security of Andersen EV or EVIOS’ Personal Data, including those measures specified in Part B of Schedule 1 (Technical and organisational measures).
10 Governing law and jurisdiction
This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.
11 Schedule 1
11.1 PART A – DATA PROCESSING INFORMATION
Processing of Andersen EV or EVIOS’ Personal Data by you under this Schedule shall be for the subject-matter, duration, nature, and purposes and involve the types of Client Personal Data and categories of Data Subjects set out in this Part A.
11.1.1 SUBJECT-MATTER OF PROCESSING:
Your provision of the installation services and any related technical support to our customers.
11.1.2 DURATION OF THE PROCESSING:
The order date or the first contact date from the customer plus any time needed to complete the first installation until the return/deletion of all Personal Data by you in accordance with this Schedule.
11.1.3 NATURE AND PURPOSE OF THE PROCESSING:
You will process Client Personal Data for the purpose of providing the installation services and any related technical support to the Processor in accordance with this Schedule.
11.1.4 CATEGORIES OF DATA SUBJECTS:
Andersen EV or EVIOS’ Personal Data will concern the following categories of Data Subjects:
Data Subjects about whom you collect Personal Data in its provision of the Services; and/or
Data Subjects about whom Andersen EV or EVIOS’ Personal Data is transferred to you in connection with the installation services by, at the direction of, or on behalf of Andersen EV or EVIOS.
11.2 PART B – TECHNICAL AND ORGANISATIONAL MEASURES
Without prejudice to its other obligations, you shall implement and maintain at least the following technical and organisational security measures to protect the Client Personal Data: Encryption.
